Did You Lose Money With Norbert Filian As Your Stockbroker?

pending FINRA arbitration (Case No. 24-01252) was filed in August 2024, by a customer of Equitable Advisors, LLC, alleging that Mr. Filian recommended an unsuitable Real Estate Investment Trust (REIT) to a customer. The claim is pending and the damages amount is not yet specified.

In an earlier matter (FINRA Case No. 23-03300), filed in November 2023, similar allegations of unsuitable REIT sales were made by a customer of Equitable. That dispute was settled for $13,367, with Mr. Filian personally contributing $8,030.00 to the resolution.

Another customer complained that Mr. Filian misrepresented the liquidity of a REIT sold in 2014. That complaint was denied by the firm and apparently the customer did not pursue the matter further.

Allegations of Broker Misconduct Against Norbert Filian

Mr. Filian has three customer disputes reported on his record with the Financial Industry Regulatory Authority (FINRA), which include:

  • Unsuitable REIT Recommendation to customers
  • Misrepresentation of Liquidity

These allegations may constitute violations of FINRA Rule 2111, which mandates that brokers make only suitable investment recommendations based on the client’s financial situation and objectives. Additionally, FINRA Rule 2010 may apply in cases involving misrepresentation or failure to disclose material facts about investment products, such as REITs, which are typically illiquid and complex.

Alternative Investments: These are assets that are not stocks, bonds or cash. Alternative investments generally fall within five categories: hedge funds, private capital, natural resources (oil and gas, energy), real estate (REITs) and infrastructure. They are typically less liquid that conventional investments, less regulated with higher fees and generally higher risk. For more investigations involving Alternative Investments, see this.

Mr. Filian is currently licensed in 10 U.S. states and territories, including Illinois, Florida, and Arizona, and is registered as both a General Securities Representative and an Investment Adviser Representative through Equitable Advisors, LLC.
