Did You Lose Money With Trey Toifel As Your Stockbroker?

In a FINRA arbitration case (No. 23-01784) filed against Cetera Investment Services LLC, a customer alleged that Trey Toifel recommended overly concentrated and unsuitable investments in structured bank notes. The matter was settled in January 2025, for $61,500 .

Another complaint, filed in May 2023, accused Mr. Toifel of failing to disclose that a customer’s funds would be tied up for 5 years in structured products. This complaint was denied by the company and apparently the customer did not pursue the matter further.

These claims potentially implicate FINRA Rule 2111, which mandates that brokers only recommend investments that are suitable for a client’s investment profile, and FINRA Rule 2010, which governs standards of commercial honor and just and equitable principles of trade.
