What is a Delaware Statutory Trust (DST) ?

FINRA Case No. 26-00475, filed by a customer of TCFG Wealth Management in 3/2026, alleges that a former registered representative of TCFG Wealth Management recommended overconcentrated positions in unsuitable Delaware Statutory Trusts, which were intended to provide tax benefits following the claimant’s sale of real estate. The broader claims asserted against the registered representative and/or firm include breach of fiduciary duty, negligence, negligent supervision, fraud, breach of contract, violation of the Securities Exchange Act, and violation of the Florida Securities and Investor Protection Act. Damages of $1- $5 million are sought in this pending matter.

The claim is asserted specifically against Ms. Tesla under the Securities Exchange Act based on allegations that she was a “control person” of TCFG Wealth Management. Delaware Statutory Trust-A Delaware Statutory Trust (DST) is a legally recognized real estate investment trust (REIT) in which investors can purchase fractional ownership in property as beneficiaries of the trust.

Since the IRS has declared ownership of real property via a Delaware Statutory Trust to be like kind property for purposes of 1031 exchange, a much broader and diverse selection of investment property is now available.
