A customer of Kestra Investment Services, LLC was paid $170,000 in July 2024 to resolve allegations that Michael Hyser recommended unsuitable investments in Direct Participation Programs (DPP) & Limited Partnership (LP) interests.

The FINRA arbitration case number 23-01140 was filed in April 2023, alleging that Hyser advised the customer to invest in Atlas Growth Partners, an oil and gas drilling operation. The customer alleged that the investment was unsuitable for their financial situation and that Hyser failed to adequately explain the risks associated with it.

  • Failure to Report Regulatory Action: In 2003, the Georgia Commissioner of Insurance fined Hyser $500 for failing to disclose the Alabama sanction when renewing his Georgia insurance license. (Violates FINRA Rule 1122 – Filing of Misleading Information).
